Terms of Service
Last updated: 9 October 2026
These Terms of Service ("Terms") form a legally binding agreement between you and WebSetGo, a sole proprietorship owned and operated by Aayush Nitin Jadhav, with its place of business at Vartak Nagar, Thane, Maharashtra 400606, India ("WebSetGo", "we", "us" or "our"). They govern your access to and use of Vestiqa, our salon management software, the website at vestiqa.in and all related services (together, the "Service").
By creating an account, starting a free trial, or accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, Refund and Cancellation Policy and Service Delivery Policy, each of which forms part of these Terms. If you accept these Terms on behalf of a salon, business or other entity, you represent that you have the authority to bind it, and "you" refers to that entity. If you do not agree, you must not use the Service.
1. Definitions
1.1 "Account" means the account created for a salon to access the Service.
1.2 "Authorised User" means the salon owner and any manager, staff member or other person whom the owner permits to access the Account.
1.3 "Customer Data" means all data entered into, uploaded to or generated through the Service by you or your Authorised Users, including details of your clients, staff, services, invoices, payments and stock.
1.4 "Client" means a customer of your salon whose personal data is stored in the Service.
1.5 "Subscription" means a paid plan for the Service on a monthly, yearly or other agreed basis, and "Subscription Period" means the period for which a Subscription has been paid or, where applicable, the free trial period.
1.6 "Applicable Law" means all laws, rules and regulations in force in India that apply to you, to us or to the Service, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 ("DPDP Act") and the Central Goods and Services Tax Act, 2017.
2. Eligibility
2.1 You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
2.2 The Service is intended solely for business use by salons, spas, beauty parlours and similar establishments, and not for personal or household use.
3. Your Account
3.1 You shall provide accurate, current and complete information at registration and keep it up to date, including your salon name, contact details and, where applicable, your GSTIN.
3.2 Each Account is for one salon business. Separate businesses or branches require separate Accounts unless we agree otherwise in writing.
3.3 You are responsible for maintaining the confidentiality of all login credentials and for all activity that occurs under your Account, whether or not authorised by you.
3.4 You are responsible for the acts and omissions of your Authorised Users, for the roles and permissions you assign to them, and for promptly removing access for any person who should no longer have it.
3.5 You shall notify us immediately at websetgo102324@gmail.com if you become aware of any unauthorised access to or use of your Account, or any other breach of security. We are not liable for any loss arising from your failure to safeguard your credentials.
3.6 Each mobile number may be used to activate one free trial only. We may refuse or cancel any trial or Account that we reasonably believe was created to circumvent this limit.
4. Licence to Use the Service
Subject to these Terms and to payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable right, during your Subscription Period, to access and use the Service for the internal business operations of your salon. All rights not expressly granted to you are reserved by us.
5. Free Trial
5.1 New Accounts receive a free trial of 14 days, unless a different period is stated at sign-up. No payment details are required to start a trial.
5.2 A trial does not convert into a paid Subscription automatically, and you will not be charged unless you choose to pay. Continued access after the trial requires a paid Subscription.
5.3 We may modify, limit or withdraw free trials and promotional offers at any time, without affecting a trial already in progress.
6. Fees, Payment and Taxes
6.1 Fees for each plan are as displayed on our pricing page at the time of purchase, or as agreed with you in writing. Fees are payable in Indian Rupees, in advance, for the entire Subscription Period.
6.2 Payments are processed by our third-party payment gateway, Razorpay. We do not receive or store your card, UPI or bank account credentials, and your use of the payment gateway is also subject to its own terms.
6.3 Subscriptions do not renew automatically. To continue using the Service after a Subscription Period ends, you must make a further payment, which is added to the end of your current Subscription Period.
6.4 Coupons, discounts and referral rewards are subject to the conditions stated with them, have no cash value, cannot be combined unless expressly stated, and may be withdrawn if misused.
6.5 WebSetGo is not currently registered under the Goods and Services Tax regime, and fees are therefore charged without GST. If we become registered, GST and any other applicable taxes will be charged in addition to the fees, and we will notify you before this takes effect.
6.6 We may revise our fees by giving you at least 30 days' prior notice. A revision does not apply to a Subscription Period for which you have already paid.
6.7 If fees are not paid by the end of a Subscription Period, a grace period of 3 days applies. After the grace period, access to the Account is restricted until payment is received. During the restriction your Customer Data is retained and you may download a backup, subject to clause 15.
7. Acceptable Use Policy
7.1 You shall use the Service only for lawful purposes and in accordance with these Terms and Applicable Law. You shall not, and shall ensure that your Authorised Users and any third party do not:
(a) use the Service for any unlawful, fraudulent or deceptive purpose, including issuing false or misleading invoices, or concealing income or transactions from any tax authority;
(b) upload, store or process personal data for which you do not have a lawful basis, the required notice or the required consent, or any data that infringes the privacy, intellectual property or other rights of any person;
(c) use the Service, including its WhatsApp, reminder or messaging features, to send unsolicited commercial communications, spam or bulk messages to persons who have not consented to receive them, or in breach of the regulations of the Telecom Regulatory Authority of India or the policies of the relevant messaging platform;
(d) upload or transmit any content that is defamatory, obscene, hateful, threatening, harassing or otherwise unlawful under Applicable Law;
(e) attempt to gain unauthorised access to the Service, to any other user's Account or data, or to any system or network connected to the Service;
(f) probe, scan or test the vulnerability of the Service, or breach or circumvent any security, authentication or access control measure, without our prior written permission;
(g) introduce any virus, malware or other harmful code, or interfere with or disrupt the integrity or performance of the Service;
(h) use any robot, scraper, crawler or other automated means to access the Service or extract data from it, other than the export features we provide;
(i) place an unreasonable load on our infrastructure, including through excessive or automated requests;
(j) copy, modify, translate, reverse engineer, decompile or disassemble the Service, or create derivative works from it, except to the extent that this restriction is prohibited by law;
(k) sell, resell, rent, lease, sublicense or otherwise make the Service available to any third party, or use it to provide services to other businesses, without our prior written consent;
(l) access or use the Service to build or benchmark a competing product or service;
(m) remove, obscure or alter any proprietary notice, trademark or branding displayed in the Service;
(n) create multiple Accounts, or provide false information, to obtain additional free trials, discounts or referral rewards;
(o) share login credentials between individuals, other than by adding Authorised Users through the features provided; or
(p) impersonate any person, or misrepresent your identity or your affiliation with any person or business.
7.2 We may investigate any suspected breach of this clause 7. Where we reasonably believe a breach has occurred, we may, without liability to you, remove or disable access to the relevant content, suspend or terminate the Account in accordance with clause 14, and report the matter to the appropriate authorities.
8. Customer Data
8.1 As between you and us, you retain all rights, title and interest in your Customer Data. We do not claim ownership of it.
8.2 You grant us a non-exclusive, royalty-free licence to host, store, copy, process and display Customer Data solely to provide, maintain, secure and support the Service, and as required by Applicable Law.
8.3 In respect of the personal data of your Clients and staff, you act as the Data Fiduciary and we act as your Data Processor within the meaning of the DPDP Act. We process such personal data only on your instructions, which you give through your use of the Service, and in accordance with our Privacy Policy.
8.4 You are solely responsible for: (a) the accuracy, quality and legality of Customer Data; (b) giving every notice to, and obtaining every consent from, your Clients and staff that Applicable Law requires; (c) responding to requests from your Clients to access, correct or erase their personal data; and (d) ensuring that any message you send to a Client is lawful and permitted.
8.5 You may export your Customer Data at any time from Settings > Backup & data. You are responsible for maintaining your own backup copies of your Customer Data.
8.6 We may compile and use aggregated, anonymised information about the use of the Service, which does not identify you, your Clients or any individual, to operate, analyse and improve the Service.
9. Invoices, Taxes and Records
The Service calculates totals, discounts and taxes on the basis of the prices, tax rates and settings you enter. You are solely responsible for verifying those settings and every invoice issued through the Service, for complying with GST and all other tax laws, for filing your returns, and for maintaining the books and records required by law. The Service does not provide tax, legal or accounting advice.
10. Third-Party Services
The Service works with services provided by third parties, including payment gateways, WhatsApp, Google sign-in, email delivery and hosting providers. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their availability, accuracy or conduct. Messages sent through WhatsApp are opened in your own WhatsApp application and are sent by you.
11. Intellectual Property
11.1 The Service, including its software, design, text, graphics and logos, the names "Vestiqa" and "WebSetGo", and all related intellectual property rights, are owned by or licensed to WebSetGo and are protected by Applicable Law. Nothing in these Terms transfers any of those rights to you.
11.2 If you provide suggestions or feedback about the Service, we may use them freely and without any obligation to you.
12. Availability, Changes and Support
12.1 We use reasonable efforts to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. Access may be interrupted for scheduled maintenance, upgrades, emergency repairs, or reasons beyond our reasonable control, including failures of internet, hosting or third-party services.
12.2 The Service is designed to continue billing without an internet connection and to synchronise changes when connectivity is restored. Data entered offline is held on your device until it is uploaded, and we are not responsible for data lost from a device before it is uploaded.
12.3 We may modify, improve or discontinue features of the Service from time to time. If a change materially reduces the core functionality of a paid Subscription, we will give you reasonable advance notice; if you do not accept the change, you may cancel and receive a pro-rata refund for the unused part of the Subscription Period already paid.
12.4 Support is provided through WhatsApp, email and the Help section of the Service, Monday to Saturday. We aim to respond to messages within 12 hours and take calls between 7 pm to 9 pm IST. These response times are targets and not guarantees.
13. Confidentiality
Each party shall keep confidential all non-public information of the other party received in connection with the Service, and use it only for the purposes of these Terms, except where disclosure is required by law or by order of a competent authority. Customer Data is your confidential information.
14. Suspension and Termination
14.1 You may stop using the Service and cancel your Subscription at any time by notifying us. Cancellation takes effect at the end of the current Subscription Period. Refunds, if any, are governed by our Refund and Cancellation Policy.
14.2 We may suspend or restrict access to your Account, with notice where reasonably practicable, if: (a) fees remain unpaid after the grace period; (b) we reasonably believe you are in breach of these Terms, including the Acceptable Use Policy; (c) suspension is necessary to protect the Service, other users or any third party from harm or a security threat; or (d) we are required to do so by law or by a competent authority.
14.3 We may terminate your Account by written notice if you commit a material breach of these Terms that cannot be remedied, or that you fail to remedy within 7 days of being notified of it. We may terminate immediately in cases of fraud, unlawful activity or a serious breach of clause 7.
14.4 We may discontinue the Service as a whole by giving you at least 30 days' notice, in which case we will refund the fees paid for the unused part of your Subscription Period.
15. Effect of Termination
15.1 On cancellation, expiry or termination, your right to use the Service ends, except that you may log in to download a backup of your Customer Data for 30 days.
15.2 After that 30-day period, we will permanently delete your Customer Data from our active systems, except to the extent that Applicable Law requires us to retain it. Deleted data cannot be recovered.
15.3 Clauses 8, 9, 11, 13, 15, 16, 17, 18, 20 and 22, and any other provision that by its nature is intended to survive, shall survive termination.
16. Disclaimer of Warranties
To the maximum extent permitted by Applicable Law, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will meet all of your requirements, will be uninterrupted or error-free, or that every defect will be corrected. All implied warranties and conditions, including those of merchantability, fitness for a particular purpose and non-infringement, are excluded to the extent permitted by law.
17. Limitation of Liability
17.1 To the maximum extent permitted by Applicable Law, WebSetGo shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, business, goodwill or anticipated savings, or for any loss or corruption of data (other than restoring data from our available backups), however caused, even if advised of the possibility of such loss.
17.2 Our total aggregate liability arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence) or otherwise, shall not exceed the total fees actually paid by you to us for the Service during the 12 months immediately preceding the event giving rise to the claim.
17.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Applicable Law, including liability for fraud.
18. Indemnity
You shall indemnify, defend and hold harmless WebSetGo and its proprietor from and against all claims, losses, liabilities, damages, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your Customer Data, including any claim by a Client or staff member concerning their personal data; (b) your breach of these Terms or of Applicable Law, including tax and data protection laws; (c) any message sent by you or your Authorised Users through or with the help of the Service; or (d) the acts or omissions of your Authorised Users.
19. Force Majeure
Neither party shall be liable for any delay or failure to perform its obligations (other than obligations to pay) caused by events beyond its reasonable control, including natural disasters, epidemics, war, civil unrest, governmental action, power or internet failures, cyber attacks, or failures of third-party hosting, payment or communication providers.
20. Governing Law and Dispute Resolution
20.1 These Terms are governed by and shall be construed in accordance with the laws of India.
20.2 The parties shall first attempt to resolve any dispute arising out of or in connection with these Terms through good-faith negotiation for a period of 30 days from written notice of the dispute.
20.3 Any dispute not resolved under clause 20.2 shall be referred to and finally resolved by arbitration before a sole arbitrator appointed by mutual agreement of the parties, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Thane, Maharashtra, the language of the arbitration shall be English, and the award shall be final and binding on the parties.
20.4 Subject to clause 20.3, the courts at Thane, Maharashtra shall have exclusive jurisdiction over all matters arising out of or in connection with these Terms, including applications for interim relief.
21. Changes to These Terms
We may amend these Terms from time to time. We will publish the revised Terms on this page with a new "Last updated" date and, for material changes, notify you by email or within the Service at least 15 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and may cancel your Subscription.
22. General
22.1 Entire agreement. These Terms, together with the policies referred to in them, constitute the entire agreement between you and us regarding the Service and supersede all prior understandings on that subject.
22.2 Severability. If any provision of these Terms is held invalid or unenforceable, it shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect.
22.3 No waiver. A failure or delay in exercising any right under these Terms does not operate as a waiver of that right.
22.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms, with notice to you, in connection with a reorganisation, the incorporation of our business, a merger or the sale of all or part of our business.
